The following GENERAL TERMS AND CONDITIONS (hereinafter referred to as GTC) apply exclusively to all contractual agreements between Mangosteen Catering, the catering service of the Zurich Marriott Hotel, and the event organizer. They form the basis of all services and deliveries provided by Mangosteen Catering.
I. Conclusion of Contract
The event contract for services and deliveries by Mangosteen Catering only becomes valid once confirmed in writing by both the organizer and Mangosteen Catering. Any services beyond those confirmed in the order will be invoiced additionally.
II. Guaranteed Number of Participants
For all events, the organizer must inform Mangosteen Catering of the actual number of participants no later than 7 working days (Sundays and public holidays are not considered working days) prior to the start of the event. Otherwise, the number of participants stated in the order confirmation will apply, and Mangosteen Catering is entitled to invoice all agreed services based on this number.

In case of cancellation after the order has been confirmed, the following charges apply:
IV. Beverage Billing
Unless otherwise agreed, all beverages will be charged according to actual consumption. Opened bottles are considered fully consumed.
V. General Liability
Mangosteen Catering is liable only in cases of intentional or grossly negligent contractual or non-contractual damage and only for direct damages.
The organizer is liable for all damages, losses, or destruction caused negligently or intentionally by themselves, their employees, agents, guests, or event participants. The organizer shall fully indemnify Mangosteen Catering against all civil and public legal claims made by authorities or third parties (including event participants, guests, employees, or contractual partners of the organizer) in connection with the event. This includes all costs such as legal and court fees, compensation payments, or fines.
VI. Invoicing
Mangosteen Catering reserves the right to request advance payments from the organizer.
Unless otherwise agreed in the event contract, all invoices from Mangosteen Catering/Zurich Marriott Hotel must be paid within 20 days of the invoice date.
All prices are gross in Swiss Francs, including the applicable VAT. Any VAT increase is at the organizer’s expense.
In the case of late payment, Mangosteen Catering/Zurich Marriott Hotel may charge reminder fees and late interest of 5%.
The customer is responsible for the material. They agree to use the items only for their intended purpose. They are also obliged to take the necessary safety measures to ensure accident-free use. The return must be made without cleaning, but free of food residues and in the original packaging. All damaged or missing items and containers will be charged according to the applicable price list. Rental materials and containers remain the property of the Zurich Marriott Hotel in any case.
VII. Additional Provisions
These GTC and the entire contractual relationship are governed by Swiss law. The place of performance and jurisdiction is agreed to be Zurich.
By signing the order confirmation, the organizer acknowledges these GTC as an integral part of the contract and confirms having read and accepted them.
VIII. Data Protection
We strive to meet all the wishes and expectations of our guests, which is why we take the protection of your personal data very seriously. The data you provide when making a reservation or checking in will be used to deliver our services and to inform you about other offers from Marriott, Renaissance, and Courtyard by Marriott.
We may also use this information to send you invitations to participate in customer satisfaction and market research surveys. For this purpose, your personal data will be shared with Marriott International, Inc., 10400 Fernwood Road, Bethesda, Maryland, 20817, USA. Data is shared with other hotels under the above brands only for reservation purposes, i.e., to fulfill a contract between you and the hotel.
Your data is shared with third parties only if they are service providers sending the survey invitations. If you do not wish to receive information about our offers, you may inform the responsible office.
